Terms of Service

1. Acceptance of terms

By downloading, installing, or using Eco ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree, do not use the Service. The Service is operated by Eco ("we", "our").

2. Description of the Service

Eco is a macOS application that captures audio from the microphone and system, transcribes and translates in real time using cloud AI services. The Service requires an internet connection and an active user account.

3. Eligibility and user account

You must be at least 13 years old to use the Service. By registering, you warrant that the information provided is accurate and you agree to keep it up to date. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

4. Plans and billing

4.1 Free plan

The Free Plan includes 10 minutes of recording per month at no cost. The quota resets on the first day of each month.

4.2 Paid plans

Paid plans (Lite and Pro) are billed through Paddle, acting as Merchant of Record. Paddle is responsible for processing payment, issuing the receipt, and remitting applicable taxes (VAT, GST, etc.) based on the buyer's jurisdiction.

4.3 Billing cycles

Paid plans can be monthly or annual. The renewal date is the same date of the month (or year) on which you activated the plan. Invoices are generated automatically at the start of each period.

4.4 Price changes

We reserve the right to modify prices with at least 30 days' notice. Changes will apply at the next renewal, not during the current period.

5. Cancellation and refund policy

5.1 Cancellation

You may cancel your subscription at any time through the Paddle portal (link in your purchase confirmation email) or by writing to hello@ecotranslate.app. Upon cancellation, your plan remains active until the end of the period already paid; no additional charges are made.

5.2 Refunds

We offer a full refund within 7 days of the first purchase of a paid plan, provided recorded usage does not exceed 20% of the plan's quota. To request a refund, write to hello@ecotranslate.app with your purchase email. Refunds are processed through Paddle and may take 5–10 business days to appear.

5.3 Automatic renewals

Subscriptions renew automatically unless you cancel before the renewal date. Paddle will send a reminder email before each annual renewal.

6. Acceptable use

You agree not to use the Service to:

• Record or transcribe third-party conversations without their consent, in violation of local privacy laws.
• Distribute, resell, or sublicense the Service without express authorization.
• Attempt to reverse engineer, decompile, or extract the source code of the application.
• Engage in illegal, defamatory, abusive activities, or activities that infringe the rights of others.
• Overload, attack, or interfere with the Service infrastructure.

We reserve the right to suspend or terminate accounts that violate these rules, without prior notice and without right to refund.

7. Intellectual property

Eco and all its components (code, design, brand) are protected by applicable intellectual property laws. You do not acquire any ownership rights over the Service by using it. Content you generate (transcriptions and translations) remains yours; you only grant the limited permission necessary to provide the Service.

8. Availability and warranties

The Service is provided "as is" and "as available." We do not guarantee uninterrupted availability, 100% accuracy in transcriptions or translations, or that the Service will be error-free. Transcription and translation accuracy depends on external factors such as audio quality, accent, and background noise.

9. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service. In no event shall our total liability exceed the amount paid by you in the 12 months preceding the event that gave rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, costs, or fees (including attorneys' fees) arising from: (i) your use of the Service; (ii) violation of these Terms; or (iii) infringement of third-party rights.

11. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for such modifications.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the jurisdiction of the ordinary courts of Santiago, Chile, unless applicable law requires another jurisdiction.

13. Changes to these Terms

We may update these Terms periodically. We will notify you of material changes by email at least 14 days in advance. Continued use of the Service after notification implies acceptance of the new Terms.
